Terms of Service

1. Agreement to Terms
By booking a session, purchasing services, accessing our website, or receiving photography services from Mischif Studio, you agree to comply with and be bound by these Terms of Service. If you do not agree with these terms, you should not book or use our services.
2. Booking and Payment
A session date is not reserved until a deposit or full payment has been received.
Session fees, deposits, and payment terms will be outlined at the time of booking. Deposits are non-refundable unless otherwise stated in writing.
The remaining balance must be paid before the delivery of final images unless other arrangements have been agreed upon.
Failure to complete payment may result in delayed delivery or cancellation of services.
3. Rescheduling and Cancellations
Clients may request to reschedule a session with reasonable notice.
Rescheduling requests must be made at least 48 hours before the scheduled session when possible.
Deposits may be transferred to a new session date once, depending on availability.
If a client fails to appear for a scheduled session without notice, the deposit will be forfeited.
Mischif Studio reserves the right to reschedule sessions due to weather, illness, emergencies, or circumstances beyond our control.
4. Creative Control
Mischif Studio retains full creative control over the style, composition, lighting, editing, and delivery of images.
Clients acknowledge that the photographer’s style is editorial and moody, and final images will reflect this artistic direction.
Specific poses, editing styles, or outcomes cannot be guaranteed.
5. Image Delivery
Delivery timelines vary depending on session type and will be communicated at the time of booking.
Final images will be delivered through an online gallery.
Clients are responsible for downloading and saving their images. Mischif Studio recommends downloading and backing up images immediately after delivery.
Galleries may expire after a designated period.
6. Editing and Retouching
All delivered images are professionally edited and color corrected to reflect the photographer’s style.
Additional retouching beyond standard editing may be available for an additional fee.
RAW or unedited images are not provided.
7. Copyright and Usage Rights
Mischif Studio retains full copyright ownership of all images created.
Clients receive a personal-use license to download, print, and share the images.
Images may not be sold, altered, edited, or used for commercial purposes without written permission from Mischif Studio.
Commercial usage rights must be purchased separately.
8. Model Release
Unless otherwise agreed in writing, clients grant Mischif Studio permission to use images from sessions for:
Portfolio display
Website and blog content
Social media marketing
Advertising and promotional materials
Clients may request privacy before the session if they do not want images shared publicly.
9. Limitation of Liability
Mischif Studio will take reasonable care in capturing and delivering images. However, in the unlikely event that photographs are lost, stolen, damaged, or corrupted due to technical failure, equipment malfunction, or unforeseen circumstances, liability is limited to the amount paid for the session.
Mischif Studio is not responsible for circumstances beyond its control, including weather conditions, venue restrictions, or interference from guests or participants.
10. Client Responsibilities
Clients are responsible for:
Arriving on time for scheduled sessions
Obtaining any required location permissions or permits
Ensuring participants cooperate during the session
Session time lost due to late arrival may reduce shooting time.
11. Website Use
All content on the Mischif Studio website, including images, text, and branding, is protected by copyright and intellectual property laws.
Users may not reproduce, distribute, or copy content without permission.
12. Changes to Terms
Mischif Studio reserves the right to update or modify these Terms of Service at any time. Updated terms will be posted on the website.
